CLIENT SERVICES AGREEMENT

This Client Services Agreement (“Agreement”) is entered into between Breathe Pilates (“Breathe” or “the Studio”) and “You” the undersigned (or “Client” interchangeably), regarding Your relationship as a client of Breathe. 

1.     Scheduling & Cancellation: Registration is required 12 hours in advance to guarantee your spot in the session. There is a 12-hour cancellation policy that applies to all sessions. If you do not cancel a full 12 hours prior to your session, you will be charged the full fee.

2.     Payments, Purchasing & Registration: By registering, purchasing and attending a service from Breathe, you agree to the terms in this agreement. A valid debit or credit card can be used for payment. Checks are not accepted. Full payment is due at time of service. All packages are non-refundable and non-transferable. Session packages expire 2 months from purchase.

     3. Studio Policies:

Studio Attire: Wear comfortable form-fitting clothes. We recommend “grippy” socks to allow for traction on the equipment and to help maintain cleanliness.

Children:  Please note that our studio is designed for adults, and we do not allow children in the session. We appreciate your understanding, as this helps us maintain a focused environment for all participants.

Therapeutic Relationship Guidelines: To ensure the best care, each new client must complete an

intake form that includes important medical information for the practitioner. It is essential for clients to inform the practitioner of any changes in their health or medical treatment during the therapeutic relationship. If any relevant updates are needed, clients can fill out a new intake form to modify their information accordingly.

Treatment, training, or education provided is not a substitute for medical care.  Clients are encouraged to make informed medical decisions in partnership with their healthcare professionals. Clients are responsible to tell their instructor immediately about pain or discomfort experienced during a bodywork and/or movement training session so the work can be modified to be comfortable, safe, and effective.

Discrimination and Harassment: Breathe is committed to providing an environment free from disrespectful or offensive behavior and providing a safe space for clients, regardless of physical or mental characteristics, race, religious or political views, nationality, disability, mental condition, gender, sexuality, or any other characteristics protected under federal, state, or local law.

Breathe reserves the right to judge behavior within the studio and respond accordingly. This right includes but is not limited to termination of client relationship without refund to any client engaging

in unacceptable behavior, in Breathe’s sole discretion, or any other remedies available to Breathe according to local, state, or federal law.

4.Miscellaneous:

Photo Release: You grant Breathe its representatives, employees, or agents the right to take photographs and video footage of You and your property while at Breathe and to use and publish these photos or videos in print and/or electronically. You agree that Breathe may use photographs or video footage of You with or without your name for any lawful purpose, including for such purposes as publicity, illustration, advertising and web content.

Email Communications: You understand that You may from time to time receive email communications from Breathe related to the Sessions, the studio, and your participation therein. By entering into this Agreement You give Breathe permission to email You, at the email address on file, regarding the same.

Release of Liability: By entering into this Agreement and as a condition to your participation in sessions with Breathe, You also agree to the terms of the Release of Liability. In doing so, You agree to indemnify, release, and hold harmless Breathe from any and all claims related to your participation in a service with Breathe. For further details, please refer to the Release of Liability.

Medical Release, Consent to Treat: You acknowledge that You should consult with a physician prior to beginning any exercise program or receiving alternative therapies and that You are not aware of any medical condition that would render You unfit to participate in a session. You will notify Breathe immediately of any change in medical condition, including pregnancy, as soon as reasonably possible.

If in the subjective opinion of Breathe You would be at physical risk participating in services at Breathe You understand and agree that You may be denied access to the session or until You furnish Breathe with a medical release form from your doctor, at your sole cost and expense, specifically addressing Breathe’s concerns and stating that Breathe’s concerns are unfounded.
